My Poker Gym Terms of Service

These Terms of Service (“Terms”) are an agreement between you and C.B.A. Services LLC, builder of My Poker Gym, a Delaware limited liability company (“we,” “us,” “our”). They govern your use of My Poker Gym at mypokergym.com and related services (the “Service”).

By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live if higher, to use the Service.

You must also be legally able to enter into this agreement. You may not use the Service where doing so is prohibited by law.

2. What My Poker Gym is (and isn’t)

My Poker Gym is a poker training and educational tool. It lets you practice decisions in simulated no-limit hold’em hands against computer-controlled opponents and see feedback on your choices.

No real money and no prizes. The Service involves no real-money wagering, deposits, withdrawals or cash-outs. Chips, stacks, pots and dollar amounts shown in the Service are simulated and have no monetary value. They cannot be bought, sold, transferred or redeemed for anything.
No contests. We do not award cash, prizes or anything of value based on performance. Any leaderboards or ratings are for recognition only.
Not a gambling service. Nothing in the Service is an offer or solicitation to gamble. We do not operate, endorse or link to real-money gambling as part of the Service. If you choose to play real-money poker elsewhere, you are solely responsible for complying with the laws and rules that apply to you. Please gamble responsibly. If gambling is a problem for you, seek help (in the US, call or text 1-800-GAMBLER).

3. Educational content, not professional advice

Strategy feedback, grades, ranges, equity estimates and explanations are educational simplifications. They are based on our models, which are “solver-style” strategies adjusted for simulated opponent types. They are not guaranteed to be correct, optimal or profitable.

Nothing in the Service is financial, gambling, legal or other professional advice. Results in the Service do not predict results at a real table. You are solely responsible for any decisions you make, including decisions involving real money.

4. Prohibited use during real play

You may not use the Service, or any output from it, as a real-time assistance tool while playing real-money or online poker. This includes:

consulting it during a hand
using it alongside online poker software
using it to obtain advice during a live game

Such use may violate the rules of poker sites, card rooms and the law. My Poker Gym is for practice away from the table.

5. Accounts

Free access. You can play a limited number of free hands without an account. We may change or end free access at any time.
Sign-in. We use passwordless sign-in links sent to your email. You are responsible for keeping your email account secure, and for all activity under your My Poker Gym account.
Accurate information. Provide an email address you control. Notify us at support@mypokergym.com if you suspect unauthorized use.
One person per account. Accounts are personal and may not be shared, sold or transferred, unless you are on a plan that expressly permits it (for example, a coach or team plan).
No circumventing limits. Do not bypass free-hand limits or paywalls. For example, do not create multiple accounts, reset or spoof device identifiers, or use proxies or VPNs for that purpose.

6. Acceptable use

You agree not to:

copy, scrape, crawl or extract strategy data, ranges or content from the Service in bulk, or use it to build a competing product or train machine-learning models
reverse engineer, decompile or interfere with the Service, except as allowed by law
probe, scan or test the vulnerability of our systems or bypass security or access controls
overload or disrupt the Service, or access it using automated means without our written permission
use the Service for any unlawful purpose, including illegal gambling
impersonate others, or misrepresent your affiliation with us

7. Paid subscriptions (when available)

We plan to offer paid plans. When we do, the following applies.

Billing. Payments are processed by our payment processor, Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method the price shown at checkout, plus any applicable taxes.
Auto-renewal. Subscriptions renew automatically at the end of each billing period (for example, monthly or annually) at the then-current price, until you cancel. We will tell you the price and renewal terms before you buy. Where required by law, we will send renewal reminders.
Cancellation. You can cancel at any time through your account’s billing portal or by emailing support@mypokergym.com. Cancellation takes effect at the end of the current billing period, and you keep paid access until then.
Free trials. If we offer a free trial, you will be charged when the trial ends unless you cancel before then. Trial terms will be shown at signup.
Refunds. Nothing here limits any right to a refund you may have under applicable law, including any statutory right of withdrawal for consumers in the EEA or UK.
Price changes. We may change prices. We will give you advance notice of a price change, and it applies to your next renewal. You can cancel before it takes effect.
Failed payments. If a payment fails, we may suspend or downgrade your paid access until the payment is resolved.
Lifetime plans. Any “lifetime” plan means access for the lifetime of the Service, not your lifetime.

8. Intellectual property

The Service and its content are owned by C.B.A. Services LLC or its licensors and protected by intellectual property laws. This includes:

software and design
strategy models, ranges and explanations
text, graphics and avatars
the name “My Poker Gym”

We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial training, subject to these Terms.

Your training data (hands, saved spots and stats) belongs to you. You give us the rights needed to store and process it in order to provide the Service.

If you send us feedback or suggestions, we may use them without obligation to you.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. THESE INCLUDE MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF STRATEGY CONTENT.

We do not warrant that:

the Service will be uninterrupted, error-free or secure
data will never be lost
using the Service will improve your results at real poker

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, C.B.A. SERVICES LLC AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES
ANY LOSS OF PROFITS, DATA OR GOODWILL
ANY GAMBLING OR GAMING LOSSES

ARISING FROM OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.

Some jurisdictions do not allow certain limitations. In those jurisdictions, these limits apply only to the extent permitted by law.

11. Indemnity

You agree to indemnify and hold harmless C.B.A. Services LLC from claims, losses and expenses (including reasonable attorneys’ fees) arising from:

your misuse of the Service
your violation of these Terms
your violation of any law or the rights of others

12. Termination

By you. You may stop using the Service at any time, and you may delete your account by contacting support@mypokergym.com.
By us. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. If we discontinue a paid Service without cause, we will refund any prepaid, unused portion of your subscription.
What survives. Sections 3, 4, 8 through 11, 13 and 14 survive termination.

13. Governing law

These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules.

14. General

Changes to these Terms. We may update these Terms and will post the new version with a new “Last updated” date. For material changes, we will give reasonable notice. Continued use after changes take effect means you accept them.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
Severability. If any provision is unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a business transfer.
